Here comes the good news...DACA
Are you a DACA recipient? There is good news! Has your DACA or that of anyone you know expired or about to expire? Did you know there was an issuance of a U.S. District Court Order for the resumption of the processing of certain DACA applications?
From Jan 13th, 2018, USCIS resumed the processing of certain DACA applications. It is unclear how long the preliminary injunction in the Regents of the University of California, et al. v. Department of Homeland Security, et al. case will remain in place. It is highly recommended for affected clients, particularly those whose DACA has expired or will expire in the next few months to take advantage of this opportunity as this brief window might be short-lived.
In summary, USCIS has advised:
Individuals who have previously received DACA may request renewal by filing the following forms:
Form I-821D
Form I-765, and
Form I-765 Worksheet
Renewal applications will be accepted from applicants whose DACA expired on or after Sept. 5, 2016
New, initial applications will be accepted from applicants who previously held DACA and whose DACA expired before Sept. 5, 2016
Applications from persons who have never received DACA will be NOT be accepted
Applications requesting Advance Parole, travel authorization for DACA recipients will NOT be accepted
DACA policy will be operated on the terms in place before it was rescinded on Sept. 5, 2017
